Vetting and Barring Scheme to be scaled back

What is the Vetting and Barring Scheme?

The Vetting and Barring Scheme (run by the Criminal Records Bureau, the Independent Safeguarding Authority and Access NI) is a new system introduced to replace:

• The Protection of Children Act (PoCA) List
• The Protection of Vulnerable Adults (PoVA) List
• The Disqualification from Working with Children (DWC) List
• The Unsuitable Persons List
• The Disqualifications Orders, and
• List 99

The scheme, which is designed to ensure that anyone who presents a known risk to vulnerable groups is prevented from working with them, was established as a result of the Bichard Enquiry, which followed the Soham Murders.

The Vetting and Barring Scheme, which launches for individuals on the 26th July 2010 will replace all of the existing barring schemes. From the 26th July 2010 any person who wants to work or volunteer with children or vulnerable adults in ‘Regulated Activity’ will be required to register with the Independent Safeguarding Authority (ISA). It will be an offense for any person to work in a regulated activity without being ISA registered and also an offence for an employer to hire a person in a regulated activity without first confirming their ISA registration.

The new scheme will allow anyone with a legitimate interest to check a person’s registration online; this not only includes employers but also individuals that employ in a private capacity tutors, nannies, carers etc. Those people with a legitimate interest will be informed if an employee becomes de-registered from the scheme.

The extent of the scale back it is not yet known with details expected in the coming weeks. The Government has been keen to scrap or scale back many projects implemented under the Labour Government in an effort to protect civil liberties and reduced the budget deficit.
