AWR Guidance to be made available today

Following an early review of the documentation Tom Hadley of the Recruitment & Employment Confederation (REC) said that “Do we now have all the answers? No, but this was never likely to be the case. It is also important to bear in mind that whatever the guidance says, tribunals will be free to make their own calls. As well as making the most of the two week window to get back to BIS on the guidance, our priority is to continue engaging with some of the UK’s leading law firms to build a legal consensus on key areas.  We will also continue to provide the best possible practical support for recruiters and to engage with employers and Trade Unions on implementation issues.”

It is likely that from October 2011 onwards traditional Contractor Limited Companies will be in favour once again as Umbrella Companies will be caught by the new regulations. Barry Roback, Director of Privilege Accounts said to Contract Eye on the issue \”Attempts to exclude all limited company contractors from AWR were thwarted by HMRC who were afraid that anyone who has a shareholding or holds office in a limited company could make it easier for unscrupulous parties to set up business models to circumvent the protection of individuals under the Directive. However, with the promise of a less heavy handed approach to genuinely IR35 friendly contractual arrangements by HMRC, limited companies could greatly benefit freelancers because they give the tax and operational advantages of being in business on their own account and eliminate agency and end user client liability under AWR.\”
