Work Permits for Bulgarians and Romanians

If you would like to work as an ‘employee’ in the UK your best bet may be to secure a UK Work Permit (Tier 2 General Visa) with a Tier 2 Licensed Employer. If however you have time to spare and your prospective employer is not Tier 2 Licensed you may be better off with an HSMP.

UK Work Permits (Tier 2 General Visas)

Tier 2 General is the new version of the old Business and Commercial Work Permit. If you are a Bulgarian or Romanian and you would like to secure a Tier 2 General Visa you will need to score at least 70 points from 3 points scoring areas (Attributes (Certificate of Sponsorship and Prospective Earnings), English Language & Maintenance).

Certificates of Sponsorship (30 Points)

You cannot apply for a Tier 2 General Visa unless you have been issued with a valid Certificate of Sponsorship from a Tier 2 Licensed Employer. You will secure 30 points for a Certificate of Sponsorship issued in one of the following categories;

• Job with an Annual Salary of £150,000+
• Job listed on the Shortage Occupation List
• Resident Labour Market Test Completed

Prospective Earnings (20 Points)

To qualify for a Tier 2 General Visa you MUST be paid a salary in excess of £20,000 per annum. Please note the actual minimum salary threshold for the role is decided by the SOC code used. The Sponsor must confirm that they will pay the required amount when assigning or applying for a CoS.

English Language (10 Mandatory Points)

If you do not speak English to a satisfactory level you will not be able to secure a Tier 2 General Visa. There are two ways in which an individual from Bulgaria or Romania can qualify;

1. Approved English Language Test held (i.e. IELTS), OR
2. Degree Qualification taught entirely in English

Maintenance (10 Mandatory Points)

There are two ways to satisfy the mandatory Maintenance requirement. Either;

• You have £800+ in personal savings which has been in your account for 90+ days, OR
• An ‘A-Rated’ Tier 2 Licensed Sponsor is confirming on the Certificate of Sponsorship that it will maintain and accommodate you until the end of you first month of employment where required

Please note that if you are applying on the basis of bank statements the balance cannot drop even £1 below the minimum threshold in the qualification period otherwise the application will be refused.
