Sponsorship Duties

If you secure a Tier 2 Sponsorship License with the UK Border Agency you will be required to meet a number of ongoing Sponsorship Duties. This guide is a summary, and is not a substitute for professional advice. If you do not meet these duties you may find that your license is downgraded or cancelled.

Recordkeeping

Sponsor’s must keep:

  • Up to date contact details for the migrant including; address, telephone number and mobile number
  • A photocopy or electronic copy of a migrant’s:
    • Passport
    • Visa Certificate (where applicable)
    • Biometric Residence Permit (where applicable)
  • Documents that may be relevant e.g. CV, Qualifications, References, Employment Contracts, Payslips & Payment Documents etc

Reporting

You must report the following information to the UK Border Agency within the required timeframes:

  • If the migrant does not turn up for their first day of work – within 10 days
  • If the migrant is absent from work for more that 10 working days – within 10 working days of the 10th day of absence
  • If their employment ends – within 10 working days (should include details of the new sponsor if known)
  • If you stop sponsoring the migrant for any reason – within 10 working days
  • If there is any significant change in circumstances – within 10 working days
  • If you have information which suggests they are breaching the conditions of their leave – within 10 working days

Compliance

You must comply with the following obligations:

  • You must ensure that the migrant who is coming to the UK to work is legally allowed to do the job
  • You must not employ someone whose immigration status does not allow them to do the job they are applying for
  • You must only assign a CoS to those that meet the requirements of the Tier

Cooperating with the UK Border Agency

You must comply with the UKBA as follows:

  • You must allow UKBA staff to access your premises on demand. Visits may be prearranged or unannounced
  • You must stick to any sponsorship action plan
  • You must look to minimise the risk of Immigration abuse by complying with good practice
